Terms of Service

This translation is provided for convenience only. In case of any discrepancies between this translation and the original in Korean, the original in Korean shall prevail.

These Terms establish the conditions and procedures for the use of the services provided by Software Creation Studio, as well as the rights and obligations of the Company and its users.

Article 1 (Purpose)

The purpose of these Terms is to establish the conditions for using the website and related services (hereinafter referred to as the "Services") provided by Software Creation Studio (hereinafter referred to as the "Company"), as well as the rights, obligations, and responsibilities of the Company and its users.

The Services are intended for users located in the Republic of Korea, the European Economic Area (EEA), and the United Kingdom.

Article 2 (Effect and Modification of the Terms)

  • These Terms come into effect when they are published on the Company's website or on the mobile service screen.
  • The Company may modify these Terms as long as it does not violate applicable legislation.
  • When these Terms are modified, the Company will announce the modified content, the effective date, and the reasons for the modification at least 7 days prior to the effective date. However, when the modification is unfavorable or substantial for users, the Company will notify them at least 30 days prior to the effective date and, when possible, will notify users individually via email or other means.
  • If a user does not agree with the modified Terms, they may terminate the usage agreement. If a user continues to use the Services after the effective date of the modified Terms, it will be considered that they have accepted the modified Terms.

Article 3 (Applicable Law and Current Regulations)

Issues not provided for in these Terms regarding these Terms and the use of the Services shall be governed by relevant Korean laws, including the Personal Information Protection Act, the Consumer Protection in Electronic Commerce Act, etc., the Act on Regulation of Terms and Conditions, and the Act on Promotion of the Use of Information and Communications Networks and Protection of Information, etc., as well as the Company's operational policies. As a general principle, these Terms are governed by the laws of the Republic of Korea.

However, when a user is a consumer residing in the EEA or the United Kingdom, such user will retain the full protection granted by the mandatory consumer protection regulations of their country of residence (including the EU GDPR, the Consumer Rights Directive, the UK GDPR, and UK consumer protection legislation), and no provision of these Terms excludes or limits such protection.

Article 4 (Provision of Services)

The services provided by the Company are as follows.

  • Proprietary solutions PolyBot and PolyGlot
  • Development of ERP systems and business automation
  • Development of responsive websites and mobile applications
  • Design and development of AI solutions
  • Development, operation, and maintenance of server and cloud infrastructure
  • Client consulting and customer service (CS)
  • Other services determined by the Company

Article 5 (Formation of the Service Usage Agreement)

The usage agreement is formed when the user accepts these Terms and completes the registration or a service request.

The Company's Services are not directed at individuals under 14 years of age, and individuals under 14 years of age may not register or enter into a usage agreement. For users in the EEA or the United Kingdom, the age thresholds established by applicable legislation (including Article 8 of the EU GDPR) apply.

The Company may refuse or restrict registration in any of the following cases.

  • When the user has impersonated another person
  • When the user has provided false information
  • When there is a risk of causing serious disruption to the operation of the Services
  • When the user does not meet the eligibility requirements, including being under 14 years of age

Article 6 (Protection of Personal Information)

The Company maintains a separate Privacy Policy and Cookie Policy to protect users' personal information and complies with applicable laws and policies, including the Personal Information Protection Act of Korea, the EU GDPR, and the UK GDPR. Details regarding the collection, use, provision, and transfer abroad of personal information are outlined in the Privacy Policy.

Details regarding data processing principles, acceptable use policy, technical limitations, and disclaimers of AI services (PolyBot, PolyGlot, etc.) are outlined in the separate AI Services Operation Policy. The Company's AI ethics principles and responsible AI operation criteria are established in the AI Ethics Policy.

Article 7 (User Obligations)

Users must not engage in the following acts.

  • Provide false information
  • Impersonate another person's personal information
  • Defame the Company or third parties
  • Interfering with the operation of the Services
  • Acts that violate laws, public order, and good customs

Article 8 (Company Obligations)

  • The Company will make every effort to provide stable services.
  • The Company will not use users' personal information beyond the scope permitted by law.
  • The Company will strive to restore services promptly in the event of a service interruption.

Article 9 (Service Hours and Interruptions)

As a general rule, the Services are provided 24 hours a day, throughout the year, although the provision of Services may be temporarily suspended in the following cases.

  • System inspection and maintenance
  • Force majeure, such as natural disasters, power outages, and communication failures
  • Other cases where there is a substantial operational or technical reason

When a service suspension is scheduled, the Company will notify in advance; when prior notification is not possible due to unavoidable circumstances, the Company will notify without delay thereafter.

Article 10 (Fees, Subscriptions, and Payment)

  • Service fees are governed by the fee policy separately announced by the Company through its website or other means.
  • Users may make payments through the payment methods designated by the Company.
  • Unless the user cancels separately, subscription services (such as PolyBot and PolyGlot) will automatically renew according to the agreed billing cycle (monthly/annually), and the applicable fee at the time of renewal will be charged to the previously registered payment method.
  • Users can cancel their subscription at any time before the next billing cycle begins. After cancellation, the Services remain available for the remainder of the current cycle.
  • When fees are increased, the Company will notify users at least 30 days before the increase takes effect, and users may cancel their subscription before the increased fee is applied.

Article 11 (Withdrawal from Subscription and Refunds)

  • Consumers in the Republic of Korea: Users may withdraw from their subscription within 7 days from the date of contract conclusion or from the date the Services became available for use, in accordance with the Consumer Protection Act in Electronic Commerce, etc. However, this does not apply when withdrawal is restricted by law, such as when the provision of digital content or services has begun immediately with the user's prior consent.
  • Consumidores en el EEE o el Reino Unido: Los usuarios podrán desistir de su suscripción por cualquier motivo en un plazo de 14 días a partir de la fecha de celebración del contrato, de conformidad con la Directiva de la UE sobre los Derechos de los Consumidores y el Reglamento de Contratos de Consumo del Reino Unido de 2013. No obstante, el derecho de desistimiento podrá restringirse cuando el usuario haya aceptado expresamente la pérdida del derecho de desistimiento y los Servicios se hayan ejecutado íntegramente.
  • Los reembolsos posteriores a los períodos anteriores, y los reembolsos derivados de la cancelación anticipada de una suscripción, se rigen por la legislación aplicable y la política de reembolsos de la Empresa. Debido a la naturaleza de los servicios prestados tras el pago, los reembolsos basados en un simple cambio de opinión podrán restringirse en la medida permitida por la ley.

Artículo 12 (Indemnización por daños y perjuicios)

Cuando un usuario sufra daños debido al acto intencionado o la negligencia de la Empresa o de sus directivos o empleados, la Empresa indemnizará dichos daños de conformidad con la legislación aplicable. La Empresa no será responsable en los siguientes casos, si bien esto no se aplica cuando la Empresa haya actuado con dolo o negligencia grave.

  • Daños causados por la culpa del propio usuario
  • Problemas derivados de información incorrecta proporcionada por el usuario
  • Daños causados por fuerza mayor, como desastres naturales

Artículo 13 (Limitación de responsabilidad)

La Empresa no será responsable en los siguientes casos, si bien esto no se aplica a ninguna responsabilidad de la Empresa que no pueda excluirse o limitarse en virtud de la legislación aplicable (incluida la responsabilidad por dolo o negligencia grave, o por fallecimiento o lesiones personales).

  • Fallos del servicio causados por fuerza mayor
  • Daños causados por problemas con el dispositivo o la red del usuario
  • Disputas entre usuarios

Artículo 14 (Gestión de las publicaciones)

  • Cuando una publicación enviada por un usuario infrinja la legislación aplicable o los derechos de terceros, la Empresa podrá suprimir o restringir la publicación de dicho contenido de conformidad con la legislación aplicable.
  • La responsabilidad legal derivada de una publicación recae, en principio, en la persona que la publicó.

Artículo 15 (Rescisión del acuerdo)

Los usuarios podrán solicitar la baja como miembro o la rescisión del acuerdo de uso en cualquier momento.

La Empresa podrá rescindir el acuerdo previa notificación en los siguientes casos, si bien la Empresa podrá restringir el uso sin notificación previa en casos urgentes o de incumplimiento sustancial.

  • Infracción de los Términos
  • Actos ilegales o interferencia con los Servicios
  • Uso fraudulento o reclamaciones reiteradas y malintencionadas

Tras la rescisión del acuerdo, el tratamiento y la conservación de la información personal se rigen por la Política de Privacidad.

Artículo 16 (Derechos de propiedad intelectual)

  • Los derechos de autor y demás derechos de propiedad intelectual sobre el sitio web, las soluciones propias de la Empresa como PolyBot y PolyGlot, y los contenidos y el software incluidos en ellos pertenecen a la Empresa o a sus legítimos titulares, y los usuarios no podrán reproducirlos, distribuirlos ni modificarlos sin el consentimiento previo de la Empresa.
  • La titularidad de los derechos de propiedad intelectual sobre los entregables desarrollados y entregados a solicitud de un usuario, como sistemas ERP, sitios web y aplicaciones, se rige por el acuerdo individual entre la Empresa y el usuario.

Artículo 17 (Resolución de disputas)

Las disputas entre la Empresa y los usuarios se resolverán, en principio, mediante consulta mutua. Cuando la consulta resulte difícil, los usuarios podrán solicitar la mediación de disputas a través de los siguientes organismos.

  • República de Corea: el Comité de Mediación de Disputas de Consumo, la Agencia de Consumo de Corea, el Comité de Mediación de Disputas de Comercio Electrónico y el Comité de Mediación de Disputas sobre Información Personal
  • EEE: la plataforma de Resolución de Litigios en Línea (ODR) de la UE (ec.europa.eu/consumers/odr) y el organismo de resolución de disputas de consumo del país de residencia del usuario
  • Reino Unido: el organismo competente de Resolución Alternativa de Disputas (ADR)

Artículo 18 (Legislación aplicable y jurisdicción)

Las disputas relativas a estos Términos y al uso de los Servicios se rigen por las leyes de la República de Corea, y el tribunal competente se determinará de conformidad con la Ley de Enjuiciamiento Civil y demás legislación aplicable. No obstante, cuando el usuario sea un consumidor, podrá interponer una acción ante el tribunal que tenga jurisdicción sobre su domicilio o lugar de residencia de conformidad con la Ley de Protección del Consumidor en el Comercio Electrónico, etc. y las normas imperativas de su país de residencia, y los consumidores del EEE o el Reino Unido conservarán la protección de los tribunales y de las normas imperativas de protección del consumidor de su país de residencia.
